Commisioned landscape work

I have been asked by a local business to do some commisioned landscape/landmark work for them.
This is the first time I have done commisioned work so I wanted some feedback on the best way to charge for this.
The options as I see them are,
1. They pay me an hourly rate plus milage allowance. They then retain copyright (or just sole usage rights?) of any photos I take.
or
2. They just buy the digital images from me under my usual terms and conditions. This means that they don’t pay for my wasted time (e.g if the weather is bad). This has the advantage to me that I can sell the images through my webpage or on to other buisnesses not in competition with the one I sold to.
What do you think guys.

markcapilitanParticipantIf it’s a commissioned job then my suggestions (from previous work for clients) would be something along the lines of:
1 – paid hourly, plus all expenses. Don’t forget the time it takes to do post processing. I would only give usage rights…you retain copyright. If they want copyright, charge them an extra fee.
2 – charge them a fixed sum (calculate the time you reckon to take the images and post process them) – calculate your expenses and add that in too, and add in the fee for all images copyright free.andy mcinroyParticipantThanks Mark,
I appreciate your advice. I’m swinging towards option 2 as it seems to allow me to retain more control of my work.

AndyGCPParticipantI have a feeling that if a client commisions the work then you can not sell it on to other users even though you do own the copyright. Owning the copyright on commisioned work means that the client can not reproduce your work without your permission but the client, I believe, also has rights on you selling to third parties the work he commisioned and paid you to do.
Its worth checking this out. It may be different in the UK. I would think along the same lines as Mark in charging also.

I suppose that would depend on the agreement that was made. I don’t think there is a general rule for “commisioned” work, although I may be wrong on this.

It is worth checking out for sure. Like I said I heard something way back from other photographers about using images
which are commisioned. I know that by right I cannot use wedding pictures I take for advertising or display without consent.markcapilitanParticipantI agree with Gerry, if it’s a commissioned job, then you should not be able to use the images without their consent. You might own the copyright, but you still can’t use them.
However, if you do the job yourself, as you were saying, and sell them on like other prints on your website, then you can do what you like with them. You simply charge them a usage fee. But the downside with this is that it is then not a commissioned job, and you wont be paid for the time you spend taking and editing the photos.andy mcinroyParticipantThanks guys,
We agreed a “per image” royalty free rate which suits us both.
Then I took a look over at Alamy and wondered how on earth those guys sell anything.
