It?s been decided for me that I should change my career and as I have been submitting photographs to regional newspapers, with a fair degree of success, I started to look at the possibility of taking the whole area of freelance photography a bit more serious. I have approached one of these newspapers and I got on better than I expected, however as this is new to me I would really appreciate help with the following question, if I do manage to start selling photographs, have the newspaper who bought them exclusive rights to that particular photograph? I have loads more questions so any advice on any aspect of freelancing would be cherished. Thanks LGW
Hi LGW. If you submit a (Non commissioned) picture to any publication all rights remain with you – Unless: A; you were commissioed by a third party – ie Wedding Photographs – You Own Copyright but you require permission from the Couple to use them in any other public way (Publication, Shop window, Exhibition).
B: You have agreed an “Exclusive” deal.
In my experience most publications do not require (or pay for) permanent exclusivity. For example if Publication X commissions you to take pictures of an event, once they have published them they are usually OK with the Photographer selling them on to other publications. Please do check with commissioning Editors before releasing pictures though!You will often see examples of this in the Irish newspapers when one Newspaper has an interesting story, the others will carry the pictures the following day.
Celebrity Glossies (Hello, OK, VIP Etc.) Would usually insist on perhaps a 4-6 week exclusivity period.
