Photography Legal in Ireland

    Hello!

    I’m new in business and want to know Legal Laws placed in Ireland about photographer rights.

    First one is copyright of course – do I need to sign contract with models?

    Second one is publishing – if my picture goes to newspaper or journal who’s holding copyrights after that?

    Final one is pictures of children NOT in studio (events, school or on street). Why I asking that becouse I was on outdoor session in public park and the guard told me not to take any pictures of kids.

    Hey there, a few quick answers. I’m sure others will elaborate a bit more.

    Yes, you should get whats called a model release form signed by the model for use of the photos. It’ll save alot of hassle later. There are quite a few online you could download. I think someone posted up one here on PI also…

    Second one is publishing – if my picture goes to newspaper or journal who’s holding copyrights after that?

    You hold the rights unless you explicitly sell the rights. If you’re asked to supply a photo for say a magazine, its best to stipulate exactly what you’re giving them the photo for ( e.g. print only for Ireland for x mths). Ashley has posted up some great posts on this, do a search and you’ll find it.

    In a public place you can take a photo of anyone you want. No-one has the right to prevent it, its not a crime. That said if a parent objects to a photo being taken, while they have no rights to have you delete a photo, you might feel that its best to do so.

    Public parks may be subject to their own by-laws though, certainly that’s the case in Cork (afaik) where there were talks of not allowing the taking of photos of children (silly I know). If you are to take photos at sports (i.e. local soccer club) or school events etc… I think that its probably best to check with the organisers to see if they’re ok with it.

    Thanks a lot Mark.
    I would appriciate if you or someone else can send me link to Law print so I can print it for my own support as I’m not native Irish and that may be the case someone want to confront me on that matter that I don’t know Irish law.

    There is no “Law” to say what is legal, only laws to say what is illegal.

    Can somebody put the link to the “photosession contract” form between photographer and model, when i tried to find on google, than i found contracts from USA :-( ,

    please help me :-)
