Cover photo – problem, help needed

The reason which i am writing this post is that i have got big problem with one of the local magazine.
The story:
I was a photographer on the Fashion Show in Bandon 4 weeks ago, i put a lot of my photos on FaceBook gallery from this event. The local Magazine took one of my photos and put this photo on the cover. Sounds good, but they put different name of author on my photo. I sent an email to the editor:
“Hello
My name is Chris
As I was a official photographer on Bandon Extravaganza 2012 from Bandon Co-Marketing Group and SuperValu Caufields sites, I would like to know where did You get the photo of Hope H. which is printed on the front cover of last “Opinion”
The reason why I am asking for is that, than I took this photo myself ! ( I am an author of this photo) and that photo has been credited to Denis B. !”and i get an answer:
“Thank you for your email.
We are very sorry for the mix-up, sometimes this happens where there are so many photos coming in to us.
If you wish we can put a clarification in the next edition. You are welcome to submit other photos to us in the future.

Jacinta”Today i bought next number of the “Opinion”. They put 4 my other photos (the worst taken this day IMO) and they put the note that i am a author, BUT they DID NOT put any note that in last number they made a mistake and i am an author of the photo on the cover, NOTHING about it, no any CLARIFICATION !!!
Now dear, users questions, what should i do ? the older number of magazine is still in the shops and every time i see my picture with different name , which make me pi…. off every time.

I know my reply doesn’t exactly answer your question but what were you expecting from a group which in effect ‘stole’ your image?

Thank you for your email. We thought we were doing you a favour by putting 4 of your photographs into this issue, with your name.
We did not intend to put any more photographs of the Extravaganza in this issue, but we did it for you. Last month’s issue is gone off the shelves since yesterday, so it is forgotten and it your photographs will be seen until the end of January. We are sorry if you are not happy with this. I think we misunderstood your complaint originally and are very sorry you are disappointed.

The SnapperMemberDid they ask your permission to use your photograph before publishing it ?
Did you submit this image to them or did they just take it from facebook, as the reply says the mix up was due to receiving so many pictures. Sounds like someone is trying to wriggle out of it as if you didn’t submit it how could they have received it!

I sent one photo to them but completely different , the photo which is on the cover is directly taken form facebook, i publish my photos from this event only on FB , thats it
They did not ask me about photos which they put on last “Opinion” as well

In the next issue we will insert the photo again of Hope Hickey and give you the credit with a clarification that the wrong photographer’s name was assigned to it in a previous issue.

First i was very surprised when i saw my photo in the Opinion, very happy , but when i looked that was sign as Denis B. is an author than i was more surprised :-)
the other way, if i put the note than can freely use my photos , probably they will not discuss with me and not apologize :-)
they just went to my account and downloaded photo (s)

The SnapperMemberWell if it was me I would be looking for a payment for use of the image especially if it is not a free mag but a commercial concern.
And have they apologised in any way for using the image without your permission :roll:

It’s very simple, you did the right thing by emailing but you should have followed up with an invoice for the picture published.
Of course your “byeline” is nice to see & expose to the readers but at the end of the day it your bank balance you need nourished.
Hope you make plenty of money from publications..

Gortan60ParticipantFully agree with the comments re sending an invoice, it is the only way some of these “publications” get the message. I had an incident last year where a local journo nabbed a pic of mine from my FB account, put it in with a report he was doing and never asked for permission. When I saw the image in the published edition, I immediately sent an invoice to the paper, and after a long and sometimes heated discussion with the editor, who was unaware of the fraudulent use, I was put on the monthly payroll of contributors! I now supply written and photo content to that paper and quite enjoy the extra cash that comes as a result!

Link? Trying to find that but not seeing anything. If I put up a photo on Facebook, I still own the image, no?
Surely that doesn’t mean anyone can grab images from their site and use it?
