I really hope someone can give me some sensible guidance here…
I’ve been asked for a couple of pictures to be used in some tourist leaflets and I’ve got 2 questions..The pictures are from sports events – do I need the host sporting organisation to give permission for the use of these pictures ? Or do I need the permission of the sportspeople themselves ? I had permission to take pictures at the event, but little or no guidance on what could be done with the pictures afterward other than that some should be considered exclusive to the folks who arranged the access.
2. If there isn’t an image-rights issue, what do people normally charge for the use of pictures in something like a leaflet ?
Any guidance would be greatly appreciated !

There are other organistations which have more info on this but the links are on my machine at home – I’ll see if I can find them later when I get home.
As for the sports images, I would imagine that you would have to get the permission of the people featured (model release) and also the organisation on whose property you took the images from, given that it is effectively private property.

The AOP site seems to be restricted to members, but the link to their book looks interesting.. it looks like it would be a good investment. They actually have an ireland-specific version for their main T&C form.
SteveFEMemberYes, technically if there is a recognisable human face you should have a model release, and technically if shot on private property you should have a release from the property owner.
Non-technically, it’s entirely down to whether the humans involved and the property owners can be arsed to sue you on a technicality (especially if it’s being used in a positive sense, to promote the place or activity. It really is highly unlikely and these sort of pics have been used hundreds of times, probably for profit, without releases, without any problems.
I can see why somebody would sue if, for instance it was a pic of a lady tennis player with her underwear showing and it was used on a titillatory or otherwise controversial website.
Just to cover my backside so to speak, this opinion is given without any form of legal expertise or comeback if you do get sued ;)

Print Run.
Circulation – Ireland, UK etc.
Size of the images.
Tones – colour or b+w.
Rights Status – is the client to recieve exclusive rights to the images.
Placement Area – cover or inside.
Right to credit.
Licensing Period.
To give you an idea, register with http://www.alamy.com, do a search for a similar image, then fill in the usage details to get a
good starting point of how much to charge. Hope that helps.DakyParticipantOne piece of information I do have specific to this particular situation is that if less than three players are in the shot the players are entitled to image rights. The body in question have used a few of my shots themselves for promotional activities and have always insisted on at least three players in the shot.

it looks like the customer needs to talk to the sports organisation directly to be clear on releases etc for the photo’s.I’ve setup the lines of communication, so we’ll see how it goes.

Good link there Valentia. Could be useful to a lot of people as a base to work from as you said.
