Folks,
I’ve a curious question (aren’t they all, eh?). On Facebook there’s a group set up for images of Wexford people & Wexford Places. Now the curator highlighted the fact that Copyright laws need to be adhered to. Fine, no problem. Then I mentioned that if the photographer is 70 years dead that this doesn’t apply…in my line of thinking from previous discussions here. But then there was a curious follow up comment:
“If the Archive of that persons work has been passed down 70 yrs won’t enter into it . .The copyright remains .”
Is this the case or is someone misguided in their judgement? Her previous comment was:
“You can only upload pictures from your own collection and those which you hold the ORIGINAL NEGATIVE or Digital IMAGE, EVERYTHING belonging to a Photographer is COPYRIGHT even if you have bought a COPY of a print, the IMAGE does NOT BELONG to you .”
Any thoughts on this?

BMParticipantCopyright on music does expire – there was recent discussion of this since some of Cliff Richard’s music will run out of copyright – the commentary being that the original time limit was defined before people started making music young and/or living as long as Sir C.
Not sure about photographs.
In any case, the statement above is wrong. You might not physically hold the negative but you might have purchased the copyright – or at least all rights to use it.

From my understanding of copyright, the copyright belongs to the original author, but this can be transferred by either he/she selling the copyright to the image, song, etc, or it could be handed down in a will to relatives if the original author has died. If the original photographer is dead for over 70yrs without it being transferred & no claim to the ownership of it has been made during this time (70yrs), the copyright ceases to exist. Many of the issues discussed above are also touched on in this article, but there are many open questions.
Issues such as “Published” works only apply, there’s still questions over unpublished works.
