    I am making a film about about a major road works near me. There are people working but no one  is recognisable. Everyone is far away, they all  have hi viz  and helmets so they are not recognisable

    But one of them challenged me under GDPR.  I am on the public road they are on private land

    I do respect their GDPR rights. Is there an exemption for this work or have i to blur everyone and car registrations.I am not being paid for it by anyone

    I could shoot and did shoot some when there are no workers but it is kinda ‘dead’ footage

    I think that if they are truly not identifiable then GDPR might not apply, however you are capturing their car regs so I would imagine that’s a problem.

    You could take a look a say the RTE news (perhaps some recent documentaries online) to see if car regs are readable etc, it might give you some idea what to do.

    Aside from GDPR, will the construction company have a problem with you videoing what is effectively their construction site?

    I only saw this now, March 29, so sorry re late reply. I am shooting from a public road and some of the development is just beside the road.I should have said some of it is on or bordering the public road as in walls too.

    But I was reading https://www.goodreads.com/book/show/1839887.Licensing_Photography and he says property may need a release. So is the work their property, is it recognisable is the question he asks. Is a public road works recognisable?

    I have heard of a differnt works where the shooter sold the footage to a different construction company.
