HELP! copyright stuff – SOLVED

  • Hi Guys, somebody sent me link of a russian website which downloaded 70 images of my old account website http://www.calaido.zenfolio.com (now off)
included their watermark . My name is displayed and the website. No license agreement at all. I mean it can be a great advertiser pool when other bloggers write about your work and display some images with link to your homepage. But THIS looks like allday.ru own rights to the image because of their watermark.

    what to do? Suggestions?

You need to get in touch with the web site and ask for them to be removed.

Failing that contact the service provider who seems to be http://www.rbcinfosystems.com and tell them to remove them.

Dont know what else you can really do. Best of luck….

    It’s a strange one.
When translated to English it says, under the images:
Warning You are not authorized to view this text.
    Author: Madeleine Calaido Weber
    Official site: http://www.calaido.com
Dear visitor, you went to the site as unregistered user. We encourage you to register or enter the site under your name.

You could ask them to remove the images or suggest they replace them with your copyright mark, as opposed to theirs.

Not sure what all they can really use them for, other than what they are currently using them for i.e. web use only.

Elena Timofeeva (lenka) – Concept, design, site creation and content management.

Drozdov Aleksey (DAY1923) – The idea and content management site.

day_lenkamail.ru – Email for your letters, which we review virtually around the clock.
We look forward to your constructive suggestions!
    Sincerely, Elena and Alexey.

Or you could thank them for their business and attach an Invoice for the use of your images.
If you use the Wayback Machine – you can probably trace how long they have been using them for.

    Cheers,
    Ashley.

I couldn’t see any picture either. Maybe they have removed it (them) ?

    Hi guys, thank you for your help : Ashley….wow with pic ( ;

I contacted them and suggested two options:

    1. remove them to avoid the road of copyright infringment
    2. replace them with 640px files which are watermarked with my logo & web.

I sent this email 1 hour ago and they reacted very fast – so they made a decision.

i would have no problem, when people or fans of the photography write an article and display my watermarked images for (noncommercial) as it is promotion as well. But to watermark them with a different logo is a no no for me.

    I’ve just discovered it’s happened me too…..

In the last 30 mins I’ve found two images of mine on a website that I think is run by someone in Instanbul.

If you go to http://www.photos1001.com/?q=lough+eask&submit=Search+Photo the first two pictures are mine… Looks like I’m going to have to start putting a copyright image in all my pictures.

    I count 3 of your :)

Beside putting your water-marked name on the files, you should also fill in the ‘File Info’ EXIF stuff – on each image, before posting any image on the Worldwide-web or sending it out the door to someone.

It won’t stop someone from using your images illegally – but it will make them easier to trace, if they have been tagged.

Try bing for example, as well as Google images.

Also, lots of helpful stuff here: Copyright Action for photographers – should you need advice or want to read-up on it all more.

    Cheers,
    Ashley.

AEDEN, that looks more like a seach engine – your images is not really taken out of context of your website – so i wouldn’t worry too much. i think watermarking them is always helpful and never underestimate the exif file – your best friend regarding web presentation.

    cheers

I don’t know if this is relevant, but I’ve seen an option on a few sites recently “Remove exif data and personal information”, Would it be possible for someone to remove your details from a photo doing this? Is there any protection (legal) preventing someone interferring with this data? It could possibly be treated as criminal damage, but I’d imagine it would be difficult to prove, especially as you would need to prove who the person was that actually done it.

Madeline: I agree it looks a bit like a search engine, but there is no clickable link that will take you to my website. The text to the right of the small picture is not a link, and even if it was it would only take to you the large jpeg for that image. If you click on the picture itself it displays the large picture which is loaded from my website all right, but the “www.toorane.com” link in the top left is not clickable on. Someone who understands the web would understand how to find me all righ but they don’t make it easy. It’s not very clear to me what the purpose of the website is.

Overall it has some marketing value for me but not a lot. I’m not terribly worried about it really. I’m planning a new website at the moment and it’s good to see this so I can plan it a bit better.

Ashley: Thanks for the pointers and yes, there are three but I can only count to two you see!! I had not spotted the third one. I’ll have to look into EXIF population of all my images and that sort of thing.

Miki: What kind of sites have that option? Next time you bump into one could you post a link? I’d be interested to see the context.

Thanks to you all for your help.
