Just got this email to my flickr account….
Hello
1977 Design is an independent creative graphic design studio based in London. We are interested in using one of your photographs as seen on your website and wondered if it is available for re-use (ie. can we purchase a digital file for use on a job)?
Our client is a business to business music library who sends cds to advertising, film and television companies. The cds are received by a large photography buying community and so would be great promotion of your work as you would obviously be credited on the artwork. The down side is that, as these cds are business to business, there is not a huge budget available.
We would hope to re-use the photograph on the web page below on a one-off, business to business music compilation cd cover.

What do I do?!

First off, you might need a model release form signed by the two guys ?
I’m sure someone here will be able to confirm or put paid to that.

First of all, well done. Maybe you’d get more replies if this was in the Business forum.
This won’t be a huge amount of help, but as far as I’m aware, model releases are only needed for advertising work. I think for a CD which was only going to businesses, the cover would be considered editorial. I’m open to correction on that cos I’m not an expert by any means.

DeeAshleyParticipantYou don’t need a model release to sell the image to them; however, they may need one signed if they are planning on using the image for advertising. So you may want to double check that with them and make them aware of it.
Selling an image with a model release signed is usually worth more than one that isn’t… because of the Usage Rights one can grant.As for how much to charge – it’s a stock image, so look up what a stock library would charge and start by quoting that.
Try Alamy for example – http://www.alamy.comIf you aren’t sure of some of the answers, just ask them and let them know you are using Alamy as your base for the price… so it’s standard rates and not some figure you are pulling out of a hat.

If you haven’t got a model release then get one. Its never any harm to have one regardless of your intentions for a particular shot.
Get the details sorted and then get it all in writing it saves any potential misunderstanding in the future and clearly sets out the terms and conditions of use e.g you being credited with the work etc…
