How much to charge for photo use?

    One of my pictures was used in a large publication recently (document – available in print and online), but without permission/not referenced.

    They are offering me 50 euro for it’s use. Is this normal?

    That sounds like normal payment, when requested, for a paper or such.

    However, since they used the image without permission, you should invoice them for 100 Euro.

    you need to invoice them for more than 100 euro! 50 euro is a joke! the effectively broke the law by using your image without your written permission. go to a solicitor. i know of a very recent case in galway where someone used some image taken from the internet without permission and they settled for 800 euro. it was no big publication and they only used it online. so don’t be afraid to talk to them about this, no matter how big they are. know your rights!

    Ya €100 or €50 is a joke for what they want to use the image for.
    When someone buys an image, a licensing agreement is done up. In it it specifies among others, the licensing period, the medium, print run and circulation area.
    The cost for a licensed image on a website depends on the company who wish to use the image. IE if it’s a high profile site. The size of the image on the site and the location of the image on the site are also big factors. The main image on a home page would cost the most.

    Usually a separate licensing agreement is done for each separate use of the image. In other words if they want to use the image for print than 2 are needed. The print run, placement area, image size and position on printed medium are all factors which dictate the price.

    There are a lot of factors which can have a huge affect on the price. It’s hard to say without knowing the details, but you should get €150 to €300 plus VAT for the website alone. You say it was printed in a large publication so I would say at least the same again for that.

    I would try and negotiate a fee rather than getting a solicitor involved if possible. If they think you know nothing about what to charge they will offer you next to nothing. If it was printed in a large publication they will be fully aware of what one expects to pay for licensed images.

    If it’s a a regional/provincial newspaper then it’s a little high. If it’s a national daily newspaper then it’s a little low. The most you’ll get for a daily newspaper is about €85 and for a Sunday paper then it’s about €100. For the provincials and locals then it can be anything from €5 up to €40 or so.

    If they used it without your permission then where/how did they get the photo? It’s up to the paper whether they credit your name or not, regardless of how/when/where they got the pic.

    If it wasn’t used for editorial use then it would depend on what it was used for, print run, length of usage, territory etc. to get an accurate price.
