    Last year I took some photos for a client (an ‘adult’ website). The shoot lasted an entire day. The work was experimental: the arrangement was that the client organised the models and MUA; there was no ‘fee’ but I retained all the rights over the images for myself. Releases were signed and client was given permission to use the low low-res images to advertise their website. Some months ago the Sunday World copied these images from the client’s website and published them on their front page to support their ‘main feature’, which was some text on the front page and a full 2 page spread inside, illustrated with more of my photos from the shoot. There were about 6 images in all, the largest one being over 1/4 of the entire front page. A few weeks later, they published them again, smaller this time. I wasn’t ever asked permission and the client knew nothing about it either. I subsequently emailed the newspaper, claiming ownership over the images and asking for payment. I asked for details of their standard rates for publications of this type so I could raise an invoice. However, though I emailed on three occasions, they never replied.

    I’ve no idea how much to charge. Does anyone have any idea how much newspapers generally pay for this type of ‘robbery’ and how much I might reasonably invoice?

    I have no idea whatsoever on what the rate should be, but the price of sending them a solicitors letter might be worth spending. I find that a lot of people ignore any contact when requesting payment until it looks like it’s going to go legal.

    I would have to agree with miki. If you ring around other newspapers and ask them prices that would give you some idea of what to charge.
    Have you tried to contact them ny any other means??

    Just pic up the phone and ask for either the Picture Editor or Editor and explain your claim.
    As a guide, a ReProduction fee could be anything from €50 to €150 for the first couple of images with a reduced rate thereafter.

    PFRE group on flickr.com has some really good info and links in the discussions section some of the links allow you calculate how much to charge depending on usage

    Guys, thanks very much for all the brilliant feedback, it’s very helpful.
    Still looking for anything relevant on the Flickr site though … it seems to be all about Real Estate photography?

    HAHA it is a Photography for Real Estate group, if you search the discussions for a key phase like charge or how much to charge it will give you a few threads with links such as:

    As the group is mainly made up of pro photographers and their shots are the kind of thing that are often used without proper licence such as a new agent listing the property and robbing the images or rights only being bought for web use and then ending up in large printed ads or editorial. it just means that it is a topic that comes up often enough. other groups are a little less about the business
