Photo used without permission

Hey Everyone,
Just a quick question regarding usage of photos posted on Flickr. All of my photos are licensed as All Rights Reserved on the site and my profile asks only that people email me to ask if they want to use a photo. Recently I found one of my photos had been used for a news report online about a local tragedy.

Image listed as a stock photo by Danielle Delaney via Flickr.Are people allowed to do this?? My friends can’t even download my flickr photos but this man used it on a news website. I’ve never had someone just use a photo without asking so I don’t know anything about it!
Any advice appreciated!

DanielleDermot1Participanttake a screen shot of the page in case they change it, invoice them and if they refuse to pay get a solicitor and sue them, they’ve clearly stolen your image.

damien.murphyParticipantThink Dermot’s suggestion may be spot on. It’s irritating for someone to flagrantly use your image, but you may as well ensure you get paid for it. An invoice to the editor of the publication may make them think twice about casually stealing images in future, although I can imagine your feelings that even that may not be entirely satisfactory.
By the way, if going the invoice route and the site refuses to pay for the image usage, there is always the recourse of the small claims court. Hopefully things will resolve themselves more satisfactorily, but it never hurts to know your options :)

I have one more question. What do I charge?? I’ve only sold photos privately to friends of friends and have no idea of pricing.
I found out by checking the stats in flickr, you can see how people link to your photos and the link for the story came up.The photo was taken a good 20 miles from the area. Not very good investigation on the piece. The journalist obviously googled Bantry Bay and my photo was one of the first to come up! What made it worse was I know the man that the story was about.
Any more advice is welcome!

DaniSgt_MajorMemberEddieParticipantLook at the advertising on the site, the publisher is not giving that space for free, he has a substantial business going here. Invoice them for at least €300 and give him 14 days for payment. You can then negotiate. Make sure you have your screen dump, get a few with different add’s on them with your image. Hopefully they will pay up without too much hassle.

DaniLook at a large stock agency’s pricing structure and charge about 50% (i.e. what you would be paid by the agency – seems fair to me)
